Terms and conditions
1.1. Online store Stamina Fitness (hereinafter online store) owner is Stamina Fitness OÜ (register code 14874792), location Järva County, Paide.
1.2. The general terms and conditions apply between the www.staminaestonia.com customer (hereinafter Customer) and Stamina Fitness OÜ (hereinafter Stamina Fitness).
1.3. Information about the goods is provided in the online store directly near the goods.
1.4. When buying a product, you agree that:
1.4.1. You are responsible for reading the full product listing before making a commitment to buy it.
1.4.2. You enter into a legally binding contract when you commit to buy a product and you complete the check-out payment process.
1.5. Stamina Fitness reserves the rights to unilaterally change these terms and conditions in order to increase the efficiency, competitiveness, further development of the products or reorganization of the product range. Changes and additions to the terms and conditions shall take effect from the moment the said information is published on the website www.staminaestonia.com.
1.6. Stamina Fitness uses Maksekeskus AS as a payment method. For more information about Maksekeskuse please visit their website www.maksekeskus.ee.
1.7. By placing an order on the Stamina Fitness website, the Customer confirms that he/she has read the terms of sale and agrees with them.
2.1. The prices of the products sold in the online store are indicated next to the products.
2.2. The prices of the products sold on Stamina Fitness website are given in Euros. All prices include VAT.
2.3. The transport price will be added to the product price according to the transport chosen by the Customer. The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when placing the order.
2.4. Stamina Fitness reserves the rights to change the prices at any time.
3. Placing an order
3.1. To order the goods, you must add the desired products to the shopping cart. To place an order you need to fill in the required data fields and select a suitable method of product delivery. The screen will then display the price, which can be paid securely through the following payment methods:
3.1.1. Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay
3.1.2. Finland bank links: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki
3.1.3. Latvian bank links: Swedbank, SEB, Citadele ja Luminor
3.1.4. Lithuanian bank links: Swedbank, SEB ja Luminor

3.2. Payments are mediated by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment - when paying with a bank link in the secure environment of the respective bank and when paying with a credit card in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank and credit card information. The agreement enters into force, when the amount due reaches the online store bank account.
3.3. Stamina Fitness OÜ is the chief processor of personal data, the company forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
3.4. By placing an order on Stamina Fitness website, the Customer confirms that she has read the terms of sale and agrees with them.
3.5. If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. delivery costs) will be refunded immediately, but not later than 14 days of sending the notice.
4.1. The purchased goods will be delivered via Omniva parcel machine within Estonia, Latvia, Lithuania and Finland.
4.2. Shipping costs are paid by the Customer and the price information is displayed next to the shipping method.
Shipments within Estonia generally reach the destination specified by the buyer within 1-2 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 2-4 calendar days.
Delays in the deliveries may occur in an emergency.
4.3. In exceptional cases, we have the right to deliver the goods within up to 45 calendar days. The customer will be informed.
5.1. The Customer may normally cancel their order (once accepted by us) for any reason up to the point of dispatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 14 days.
5.2. If you wish to cancel your order after Stamina Fitness has sent out the products, the Refund terms will apply.
6.1. The Customer has the rights to return the products and receive a refund within 14 days from the date of delivery (transport cost of delivery and return will not be refunded). When wanting to return the products you must contact Stamina Fitness via e-mail email@example.com.
6.2. When the products have been ordered to the Omniva parcel machine you will be sent a return code with a message when the products have reached the parcel machine. With this code you can return the product using the parcel machine. Please note that when returning the product, the shipping cost of the return will be deducted from the cost of the returned products. Omniva parcel machines are only available in Estonia, Latvia, Lithuania and Finland.
6.3. The costs of returning the goods shall be borne by the buyer, unless the reason for the return is due to the fact that the product to be returned does not correspond to what was ordered (eg wrong or defective product).
6.4. The refund money will be returned to the same bank account from which the money was received by us. The money will be returned immediately after we have revised the condition of the product (but not later than after 14 days), except for if we refuse the refund. We can refuse the refund if the products are damaged by the Customer or the product has not reached Stamina Fitness (and the customer has not provided proof that he/she has returned the products).
6.5. The online store may refuse to make refunds until the item that is the subject of the contract has been returned or the buyer has provided proof that she has returned the item, whichever is earlier.
6.6. In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is in the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store. The returned products must not have been used and have the swing tag attached.
6.7. If the goods have been used for purposes other than those necessary to the nature, characteristics and functioning of the goods or have signs of use or wear, the online store has the right to reduce the refundable fee according to the decrease in the value of the goods.
6.8. If upon receiving the products, the Customer discovers that the wrong or defective products have been sent to her or the products do not reach the Customer in good condition and in a sealed package, the Customer must immediately contact Stamina Fitness by writing to firstname.lastname@example.org.
6.9. Stamina Fitness is responsible for the products purchased by the Customer during its transportation. From the moment of receiving the products, the risk of damage or loss of the products passes to the Customer.
6.10. The online store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.
7. Processing of the Customers personal data
7.1. The owner of the online store is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
7.2. Stamina Fitness will use the personal data provided by the Customer and data on the purchase made in accordance with the Personal Data Protection Act to the extent necessary for the fulfillment of the order submitted by the Customer. Stamina Fitness will not transfer the Customers personal data to third parties, except to the postal service to the extent necessary for the delivery of the products to the Customer.
7.4. The online store will send newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish by entering the e-mail address on the website and has indicated his/her wish to receive direct mails.
7.5. The buyer can cancel the offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions provided in the e-mail containing the offers.
8. Filing a claim
8.1. The online store is liable for non-compliance or deffectly goods sold to the Customer with the terms of the contract, which already existed at the time of delivery and which becomes apparent within 6 months from the delivery of the goods to the buyer. During the first six months from the delivery to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the online store to rebut this presumption.
8.2. The customer has the right to contact the online store within two months after purchase by sending an e-mail to email@example.com or by calling +372 5838 0095. In the complaint, please indicate the name and contact details of the Customer, the date of submission of the complaint, the defect of the products (preferably picture) and the content of the submitted claim, and attach a document certifying the purchase.
8.3. Stamina Fitness will not be liable for any damage or any other consequence arising from incorrect information provided by the Customer during the execution of the order, including delay in delivery, if this is due to circumstances beyond Stamina Fitness control.
8.4. Stamina Fitness is not liable for defects that have occurred after the delivery of the goods to the buyer.
8.5. If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will return all fees associated with the sales contract to the buyer.
8.6. The online store will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 14 days.
9. Dispute settling
9.1. If the buyer has any complaints about the online store, they must be sent to the e-mail address firstname.lastname@example.org or by phone: +372 5838 0095.
9.2. Disputes arising between Stamina Fitness and the Client shall be resolved by the parties through negotiations. If no agreement is reached, the Customer has the right to turn to Tarbijakaitseametisse, the Consumer Complaints Commission and / or the court of his/her place of residence to protect his/her rights. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Buyer and the online store. The review of the Customer's complaint by the commission is free of charge.
9.3. The buyer can turn to the European Union Consumer Dispute Resolution Platform.
10. In case of defective products, the Customer has the right to:
10.1. Demand free repair of the products or their replacement with new products.
10.2. Require withdrawal from the contract if:
10.2.1. Stamina Fitness is unable to replace or repair the products;
10.2.2. Repair fails;
10.2.3. Stamina Fitness has not fixed the product defect within a reasonable time;
10.2.4. The repair or the replacement of the products has caused unjustified inconvenience to the Customer.
10.3. The Seller is not liable for defects in the products if:
10.3.1. Product defect is caused by improper use or negligent maintenance, the product has already been opened or repaired by not our company;
10.3.2. The defect is caused by overvoltage, water or fire or other circumstances beyond the control of the manufacturer.
